Labelcity Terms and Conditions

Welcome to labelcity.co.nz. Labelcity NZ is operated by Labelcity Pty Ltd trading as Labelcity (“Labelcity”).

These Terms and Conditions apply to all purchases made via our website www.labelcity.co.nz (“the Site”). They must be read together with our Privacy Policy, Security Policy, Returns Policy, Shipping Policy, and Product Warranty.

These Terms and Conditions, together with the laws of New Zealand, apply to all transactions for the purchase of Labelcity products (“Products”) through the Site.

These Terms and Conditions represent the entire agreement between Labelcity and you (“the Buyer”). Placing Products in the shopping cart and completing checkout on the Site constitutes an offer to purchase (“Order”). Labelcity may accept or reject the Buyer’s offer at its discretion.

Prices

Prices for all Products are those current on the date of purchase, less any applicable discounts. Delivery fees are calculated at checkout unless otherwise stated.

Labelcity may change prices without prior notice. All prices on the Site include New Zealand Goods and Services Tax (GST). GST and delivery charges are shown as the Buyer completes checkout.

Email Address and Invoices

The Buyer must provide a valid email address to process an Order and receive confirmations and tax invoices. Please check junk or spam folders if emails do not arrive. A packing slip may also be included with the shipment.

Stock Availability

If a Product becomes out of stock after an Order has been placed, Labelcity will contact the Buyer to arrange revised delivery, a substitute, or a refund.

Orders

When purchasing Products the Buyer must select:

• The Product or Products to be purchased
• The quantity required

The Buyer must also provide:

• Delivery address
• Billing address
• Name and contact details of the person placing the Order

Orders will not be accepted if:

1. Payment is not made by an approved method
2. The payment provider does not confirm payment

Once an Order is placed, Labelcity will send an email acknowledgement. If the Order is not accepted, the Buyer will be notified by email.

Order Modification or Cancellation

Labelcity requests that Buyers carefully check their Order and delivery details before submitting.

Orders are processed several times daily. To modify or cancel before shipment please email sales@labelcity.co.nz before 11.30am NZT or call 0800 152 235 as soon as possible. Orders cannot be modified or cancelled once shipped.

Delivery

• Orders within New Zealand are shipped by Castle Parcels, NZ Post Courier or a comparable carrier selected by Labelcity.
• Typical delivery timeframes are 1 to 2 business days for North Island, and 2 to 3 business days for South Island. Remote or rural areas may take longer.
• A signature may be required. If undeliverable, parcels may be held at a depot or local collection point.
• Orders may ship in multiple consignments. Tracking will be provided where available.

The Buyer acknowledges that delays may occur. Labelcity may allocate Products among customers at its discretion during supply constraints.

If an Order has not been delivered within a reasonable time, the Buyer should contact Labelcity on 0800 152 235 or sales@labelcity.co.nz. Tracking may also be available on the carrier’s website.

Payment

The Buyer may purchase Products by:

• Visa, MasterCard or American Express via eWAY
• Visa, MasterCard or American Express or funds transfer via PayPal
• Direct Deposit

Credit card information is verified by eWAY or PayPal. The Buyer agrees to provide information reasonably requested to authorise and verify purchases. Labelcity does not process or retain full credit card numbers or card verification values.

Card providers may apply additional security measures such as Verified by Visa, MasterCard SecureCode or American Express SafeKey. Labelcity has no control over these systems. For card or bank issues please contact your provider.

Labelcity reserves the right to exercise lawful remedies if a payment dispute arises. If a payment is rejected, Labelcity may delay or cancel delivery at its discretion.

Defective Products

If the Buyer believes a Product is defective or not of acceptable quality, the Buyer must contact Labelcity. Where a defect is confirmed, Labelcity will provide return instructions and may supply a prepaid return label. Products should be returned with original packaging and all included components where possible.

Once received and assessed, Labelcity will repair, replace or refund in accordance with the New Zealand Consumer Guarantees Act 1993 (CGA) and any applicable manufacturer warranty.

Incorrect Supply of Order

If the Buyer receives the wrong Product due to a Labelcity error, the Buyer must notify Labelcity within 7 days. The incorrect Product must be returned unopened and in new condition. Labelcity will arrange collection and ship the correct Product at no cost.

Products Damaged in Transit

If a Product is damaged in transit, the Buyer must notify Labelcity within 48 hours and note “Received Damaged” with the carrier if possible. Contact sales@labelcity.co.nz or call 0800 152 235 and provide the consignment number.

Delivery Outside New Zealand

For Australian customers please order via labelcity.com.au. Buyers in other regions should contact us for assistance and a shipping quote.

Amendment of Terms and Conditions

Labelcity may revise these Terms and Conditions at any time. Buyers are encouraged to revisit this page periodically for updates.

Labelcity Product Warranty

Non-Labelcity Product Warranty

Products not manufactured by Labelcity are covered by the relevant manufacturer’s warranty. Please refer to the manufacturer’s website for their terms.

Third Party Companies and Products

Mentions of third party companies, products or websites are for information only and do not constitute endorsement. Labelcity is not responsible for their quality, safety or suitability. Links are provided for convenience only and lead to external sites outside Labelcity’s control.

Buyer’s Use of the Site

The Buyer agrees not to:

1. Use the Site for unlawful or prohibited purposes
2. Copy, sell or exploit Site content without written consent
3. Collect or store personal information of other users
4. Attempt unauthorised access to any part of the Site, or upload viruses, worms or malicious code
5. Fail to take reasonable precautions to protect their own computer system

Labelcity may refuse service, cancel Orders or terminate accounts if misuse is suspected.

Trade Marks and Copyright

“Labelcity” and other marks on the Site may be trade marks owned by Labelcity or used under licence. Buyers must not do anything that places Labelcity’s trade marks at risk. Unless stated otherwise, all text, images and materials on the Site are copyright Labelcity. Buyers must not reproduce, modify or distribute them without prior consent.

Site Security

Labelcity takes reasonable measures to maintain a secure Site but does not warrant that servers or emails are free from viruses or harmful components. Buyers should protect their devices accordingly.

Labelcity is not liable for damage to computer equipment arising from Site use or downloads, or for consequential loss arising from use or inability to use Site materials, to the maximum extent permitted by New Zealand law.

Disclaimer

The Site and its content are provided “as is”. To the maximum extent permitted by New Zealand law, Labelcity disclaims all warranties not expressly stated on the Site, including implied warranties of merchantability and fitness for purpose. Labelcity does not warrant the accuracy or completeness of information on the Site.

Limitation of Liability

To the maximum extent permitted by New Zealand law, Labelcity’s total aggregate liability for any claim arising out of or in connection with the Site or an Order will not exceed the amount paid by the Buyer for the relevant Products.

Governing Law

These Terms and Conditions are governed by the laws of New Zealand. The parties submit to the non-exclusive jurisdiction of the New Zealand courts.
